These App Terms apply to your use of the Battery 1st app, currently known as Battery 1st App.

By downloading, accessing or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. About the app

The Battery 1st app is provided by Battery 1st Energy Ltd. The app may allow you to view system information, monitor performance, manage account details, receive notifications, access support, and, where available and enabled by you, use optional optimisation, export or grid-services features.

Some app features depend on compatible hardware, connectivity, cloud integrations, firmware status, metering, permissions and service availability.

2. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for your own personal, lawful and non-commercial use in accordance with these Terms.

We reserve all rights not expressly granted.

3. Accounts and security

You are responsible for keeping your login credentials confidential and for activity on your account unless caused by our fault.

You must notify us promptly if you believe your account has been accessed without authorisation.

4. App functionality

App functionality may vary depending on your equipment, installation status, jurisdiction, firmware, tariff setup, export permissions, communications status, device compatibility and the optional services you choose to enable.

We may add, remove, improve or modify app features from time to time for legal, technical, security, commercial or operational reasons.

Where a change materially reduces a paid or contracted feature, we will act reasonably and in accordance with applicable law.

5. Optional optimisation and grid-services features

Some app features may relate to optional optimisation, export, flexibility or grid-services participation.

Those features may be subject to separate key terms and full service terms presented to you before activation. You must review and accept those terms before the feature is enabled.

Enabling such features may allow us or our specialist service providers to process relevant system, device, meter and usage data and to apply automated control actions, recommendations or participation logic in line with the applicable service terms.

6. Notifications and communications

The app may send account, system, service, support, maintenance or promotional notifications, subject to your settings and applicable law.

You can manage certain notification preferences within the app or your device settings.

7. Acceptable use

You must not: use the app unlawfully or fraudulently; reverse engineer or tamper with the app except where the law allows; introduce malware or interfere with operation; attempt to access systems or data without authority; or misuse any feature in a way that could harm us, other users or connected services.

8. Device and app-store terms

Your use of the app may also be subject to the terms of the relevant app store or device provider. Those providers are not responsible for the app itself unless their own terms say otherwise.

9. Availability and support

We do not guarantee that the app will always be available, uninterrupted or error-free. Access may be affected by maintenance, updates, internet outages, hardware issues, partner systems, cloud providers or matters outside our reasonable control.

10. Suspension or termination

We may suspend or terminate your access to the app, or some features, if: you seriously or repeatedly breach these Terms; we reasonably believe there is fraud, misuse, a security issue or unlawful activity; a connected service is withdrawn or becomes unavailable; or we need to do so for legal, operational or safety reasons.

Where appropriate, we will try to give reasonable notice.

11. Intellectual property

All intellectual property rights in the app and related content are owned by or licensed to us unless otherwise stated.

12. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

To the fullest extent permitted by law, the app is provided on an “as available” basis. We are not liable for losses arising from outages, compatibility issues, inaccurate third-party data, meter issues, connectivity failures or device faults, except where caused by our breach of law or contract.

Nothing in these App Terms changes your statutory consumer rights.

13. Privacy

Use of the app is subject to our Privacy Policy and Cookie Policy or equivalent app technology notice where relevant.

14. Governing law

These Terms are governed by the laws of England and Wales, subject to any consumer rights that allow you to rely on mandatory protections in your home jurisdiction within the UK.
